Formal Hearing Officer After Revocation
My question involves a driver's license issued by the State of: IL
Convicted of: Aggrevated DUI and Involuntary Manslaughter (Under 21 years of age at that time. I am now 24 years old).
I was convicted in December 2005. Served 24 weekends in jail and was given 4 years probation. One year consisting of Intensive Probation and 3 years of regular probation.
My sister passed away in the car accident. I was the driver and she was the passanger. We were both drinking and celebrating my birthday. I made the wrong decision to drive, a decision I regret dearly.
I attended a Formal Hearing in Mount Vernon, IL on 22 SEP 2008. I brought all the paperwork the Secretary of State required.
I honestly answered all the questions the Hearing Officer asked me. There was one question that I answered honestly, twice - but when I got home and looked over my medical papers, I noticed that I answered incorrectly. The quesiton was, "Did you ever use any illegal drugs". Facts show that I did have canabis in my system. I did not remember smoking canabis that night - and there was not much I remembered after the accident.
Even though I have abided by my Probation rules, I work Full Time, all my random urine test have been clean, and my husband is deployable and needs to go TDY in NOV for 5 weeks, can I still be denied for answering that question unintentionally wrong?
Should I expect to be denied (as every one says that the first time you are always denied, no matter how clean and good you are.), or should I stop being so pessimistic about the situation.
They (people) also say that the Hearing Officers do not believe your serious about getting your license back unless you bring an attorney with you. I tried to go with an attorney but can not afford $3000 just to hold my hand the entire way (as one attorney put it).
This is my FIRST DUI in the United States of America. Submitted to a blood test. My evaluation diagnosis is Abuse. Just a couple of facts to receive facts instead of what "people" say will happen.

Have you tried to have your answer corrected? You might want to do that, else it will look like you were intentionally lying.

Who is "everyone", and why do you think they know anything at all about your situation?
There is no policy of automatically denying a petitioner just because it's their first time.
We can't tell you whether or not you'll be denied. No one can. Your behavior and your work at getting yourself back on the straight and narrow will have to speak for you.
