    My question involves criminal law for the state of: Ontario Canada


    Here is how it goes.

    I was leaving a house on saturday with a cup in hand. 3 houses away from the house a undercover cop sees me and writes me a ticket for open container. I had like 10 ml left in the cup. I could argue i was walking on the lawn (private property) but w/e.

    I'm worried cause i got a drinking ticket in may 2005 and one this summer. Now that this is a third I'm worried it goes on a criminal record.

    I'm wondering if the first ticket will have cleared by this time, and if the culmination of three tickets will result in a criminal record.

    If there is a criminal record at stake then I think that i could go to court and hope the officer doesn't show up, which would clear me. That's how it works for speeding tickets at least.
