Dependent Income and the Means Test
My question involves bankruptcy in the state of: CA
My girlfriend is permanently disabled and we've been living together for the past 10 years. She receives $1231 S.S. disability each month. That money is co-mingled in our joint checking account.
I claim her as a dependent.
Do I need to add that income to my income when I do the means test? She will be filing Chap 7 also...but separately since CA doesn't recognize common law marriage.
Thanks in advance, Barry

I believe LawResearcherMissy answered this same question for you in this thread: http://www.expertlaw.com/forums/showthread.php?t=58502
Re: Dependent Income and the Means Test
Yes, she answered it, but not fully.
Since my dependent's S.S. income is comingled with mine, how do I determine what percentage she contributes. All her income goes into the pot for bills, food etc. Should I figure 50% of her income gets added to mine...100%?
That's what I really need to know.
Thanks in advance, Barry
