Michigan Retail Fraud, Civil Damages
My question involves criminal law for the state of: Michigan.
Does anyone know what happens if you dont pay the civil damages. My daughter which is 17, changed the price on two shirts, paid for them and got caught, my 14 year old was with her, so the store hit them both with 189.00 each for vcivil damages, even though the have both shits and my girls never got out of the store. But they both must now pay 189.00 to Meijers in fFlint, Mi. Does anyone know what they cvan do if they dont pay it. Neither girl has ever been in any kinfd of trouble before this. Thank you
Re: Michigan Retail Fraud, Civil Damages
For starters, this isn't THEIR civil demand, it's YOURS bc they are minors. If you don't pay for the damages, the store can file criminal charges on them. You dont want this to happen. Then the kids will be in more trouble. Price switching is shoplifting and they can be charged criminally. It doesn't matter if they got out of the store with the stuff or not.
If you dont' pay the demand, the fine will go up and up. They then may or may not take you to court. If they do, they will very likely get a judgement and it will be against you bc they are minors.

Ok, I get that but why should the 14 year old be responsible when she did not do anything, only my 17 year old, did. Also the rent a cop when she grabbed my 14 year old, left bruises all over her arm and she did not even try to resist. Is there anything I can do about that? If I were to leave brusies on her I would end up with protective services on me.

I am assuming the 14 year old was present and had knowledge or in some way participated thats way. Far as the assault goes you can talk to Store Manager or hire an Attorney about assualt charges
Re: Michigan Retail Fraud, Civil Damages
I never understand why parents get like this. BOTH OF YOUR CHILDREN KNEW OF THE SHOPLIFT and/or SHOPLIFTED! So make them own up to it by working the money off each and what ever else you will do. Pay the fines and make sure they dont get charges filed against them. How do you know your daughter did not resist in any way? Because she told you so! Kids LIE in times like this or maybe dont remember how they reacted in a high stress situation like that. You can get an attorney and see what you can do about that.
