My question involves criminal law for the state of: Ohio
I am 17 and was recently smoking a blunt in my car with my friend parked on a street needless to say someone called the cops on us for being in my car, it was only 9 at night but still dark the cops saw us in my car and came to my window, clearly it was obvious we were smoking but i denied it, once we were out of the car they said that had full right to search the car because marijuana smoke was coming out the window, after searching it they found the half a blunt and told me i was being charged with possession. But they told my friends mom he was being charged with paraphernalia so we could keep our licenses. Sense he was with me don't we both have to get the same charge? i really don't understand this because they told me i was getting possession but told her differently. if this is my first offense and i am getting charged with only paraphernalia because they didn't find weed only the half a blunt what can i expect to get from all this? They said they were going to be sending it to a juvenile court and we would hear from them. I really didn't think the cops would make such a big deal over a blunt but i was clearly wrong. Any help would be greatly appreciated thank you.
