    Car Repossession Post Bankruptcy
My question involves bankruptcy in the state of: OHIO

we filed a chapter 7 which was discharged the beginning of this year. we had 2 cars that were a part of the bankruptcy, one was repossessed, the other has not been. is there a time frame for them to take the car or will i be in perpetual wonder as to if/when they'll take it? i've not made any effort to hide it, or my change of address. i've also not made any effort to contact them. are there legal repercussions i could face? if they want it, its here. i've had absolutely NO contact from them, tho.

What did your attorney tell you to do with the car?

he didn't say anything, basically that they could take it, primarily if they deemed it worth their while. but if not, they wont take it??? so is there some statute of limitations they have to take it within?

The only way they CAN'T take it is if the loan is paid in full or if it's protect under your bankruptcy filing. Otherwise, there is no SOL on when they can come and get it.

Agree, there is no time limit that they have to come & get the vehicle. Sometimes they *may* not come & get it if it isn't worth much - they may believe it isn't worth their time/worth their while.
