    Hi im on probation in wayne county michigan for (felony probation) atempted false pretence, i got 2 years probation and had to pay restitution of 1800 well i did everything and paid it off completely and never have had any troubles with my probation at all well im on my last month of probation and i got a ouil drunck driving (.14) is what i blew well my probation officer went to do my discharge papers in and seen i got the ouil 2 weekes befor discharge now he said hes got to violate me because i was found guilty on the ouil.Im wondering what may happen when i go to court on the violation??? it hold 3 year max. can anyone help answer my question??? i got a plea on the ouil no jail just probation.But im wondering what may or could happen at the violation court date in wayne county??????     Violation of Probation
    A wide range of things could happen, from your simply being discharged from probation to your being sentenced to a period of incarceration. Has your probation officer given you any indication of what he will recommend?

    No not yet he hasnt hes out of town tell Jan 3rd 2006 ill see him then but i was wondering does he make a recommendation to the court of probation violations? Thanks

    Yes, the probation officer usually recommends a sentence for a violator.

    New charge while on probation.
    If you get into an alcoholic treatment program before the probation violation, the judge may go easy and allow you to stay out of jail to complete it. You should also attend as many AA/NA meetings as possible and have them fill out the attendance slips so you may present the judge with proof of attendance. It will be all about admitting that you have a problem that was here to fore "ignored" and needs to be adressed now. Do you see what I am saying? The point to be made in court is that this is a misdemeanor, a serious misdemeanor, but just the same you have taken control of the situation and are doing everything in your power to fix it. You will probably be found guilty on the DUI or OUI so this really is the only approach you have. http://www.probationmanual.com

    wondering what happens
    The same thing happened to my boyfriend. He is on felony probation for three years and got an OWI a few weeks ago he reported it to his probation officer and is now is going before the judge. He thinks he will be doing time until Feb 2007. I would love to find out what happens with you. I haven't heard from my boyfriend since he went in to see the judge this morning.
