    Penalty for assault causing bodily harm
    My son is 22 years old and got into an altercation with someone at a bar. My son was defending a friend and wound up getting charged with aggravated assault which is now reduced to assault causing bodily harm. He plead guilty and now must see a probation officer then be sentenced after a pre-sentence report. My son is borderline and did not realize that he had plead guilty. I am shocked at the severity as this is his first time offence and he felt trapped by this party. I canot imagine my son having a criminal record over a outside altercation at a bar? Is there anyway to reneg on the plea deal and maybe fight this? My son's life will now be ruined because of this. Help!

    Sure he did. He's 22, a grown-up, and borderline personality disorder wouldn't affect his cognition. He was asked to enter a plea, said "guilty", and then stated facts sufficient to support his plea - it's hard to argue that as a mistake.

    Possibly; but if you are interested in pursuing that option you should retain a criminal defence attorney.

    my son has learning disabilities and has cognitive problems. He did not realize that he was entering a plea. I finally got a hold of his lawyer and told him so. We must now meet with the lawyer. It has turned into a nightmare.
