    Being Sued Over a Questionable "Accident"
    My question involves an injury that occurred in the state of Pennsylvania.

    A individual alleges that I struck his wife while she was walking on the shoulder of the road with my motor vehicle. This is a "made up" accident since I was with my stepfather at the time of the accident. The man claimed he had filed a police report. But I was not contacted by the police concerning this incident.

    I later learned that a police report was filed but the report stated that the individual only wanted the police "to be advised" and did not wish to file a formal report. Thus, the police did not investigate the "accident". I believe by law, the police are required to investigate any accident which involves an injury or death. A year later, I am being sued in civil court for the "accident".

    What should I do?

    Tell your insurance company immediately. That should be top priority. If you don't they might refuse to pay on any claims.

    I doubt it makes any difference whether or not he told the police he would sue you. If he told the police he wouldn't sue you I'm quite sure he isn't bound to that.

    If you've already been served then you don't have much time to act. Again, contacting the insurance company is priority number one.
