    Rights After Getting Kicked Out At 16
    My question involves child abuse or neglect in the State of: Michigan

    Long story short my Dad kicked me out for calling my step Mom a name, and for eating Ramen noodle in my room... I'm 16 years old, and I know that's illegal... So I have a few questions... (He's since let me back but's making me pay for the high speed internet, even though my Step Mom uses it for work... lol. Oh well, I know that's legal.)

    1. What kind of charges could he face for that? He's hit me before, and recently has threatened me with physical violence.

    2. Several things I use and have in my room belong to my friends... My PC, Monitor, Mouse, two Subwoofers, and an expensive graphics card belong to four other people... I asked my Dad for them and he said that he paid for them so he won't give them back without proof of a receipt.

    3. When he kicked me out, he kept saying how if I took anything, he'd call the police and have me arrested... I know he can have them come and arrest me, and at least detain me until he gets home, but can he have them keep me there indefinitely? If so, how much is Juvenile Hall on average???


    Edit*** If my Dad wouldn't give my friends parents their things back, would the police be able to make my Dad give them back, or would the police take my Dad's word over my friends parents?

    Before you guys go off thinking I'm some kind of bad kid, I'm really not... I've never been arrested, never been suspended, and rarely if ever break the law... My Step-Mom twists the small things I do into big things and makes my Dad go postal...

    He could face arrest for child neglect. As your parent/legal guardian, he is legally responsible for you and doesn't just get to decide to deny you food, shelter, etc. If he throws or locks you out, you call the police or child protective services who will give him the option to fulfill his obligation to your welfare or go to jail.

    Believe it or not, parents are allowed to physically discipline their children. Even at your age, they can spank you. Sucks, but true. What a parent CAN'T do is threaten or inflict bodily INJURY (bruises, marks, etc.), or use physical discipline likely to cause injury (like slapping in the face) as that could constitute abuse. So it's NOT the standard that they can't be physical, it's a standard that they can't cause HARM. If you feel that what is happening is abusive, you can report it to child protective services.     If dad plays hardball, the friends or their parents can take him to court for return of the items - assuming they can establish the items as theirs.

    A juvenile arrest for theft from parents isn't going to land you anywhere but back home after you've been processed and scheduled for a court date at some time in the future. If dad wants you held in a custodial setting of his own accord, and not via some court-ordered intervention, he'll have to come up with the bucks to place you in a boot camp or similar program.

    The police might suggest to dad that he return items that someone else claims are theirs, but since the items were willingly loaned to you, and dad as your parent is basically lord and master of anything in your possession, the bottom line is that the police will tell those parents to file a claim in civil court.

    Well regarding the items, I'm taking them all out of the house on Monday save for my PC, and my friends parents will have a receipt for that. Alls he asked for when I asked for them was a receipt, I already have one with all the parts for my PC (I bought it and used my friends case, my Dad still thinks it's their parts.), so I'll just photo shop it to look like it has the monitor and keyboard. That's legal right?
    When I mean hit, I mean punched. He didn't spank me, lol, I know that's legal... He punched me so hard in the chest it hurt to move my upper body for several days. He talks about how if I "Look at him like I'm some kind of tough guy" he'll kick my ass.

    If you feel your in danger contact the local CPS.

    As for constructing the receipts look. That is illegal and you could get in trouble for it.

    Sorry, I should have picked up on that... I didn't think it was illegal because I was lying to my Dad and not a Court or Police Officer... Looks like my best bet is to just get my stuff out of here ASAP... I have a pretty good feeling this will happen again.
