Deferred Entry of Judgement
My question involves criminal law for the state of: CA
My son received a DEJ for a misdemeanor drug charge. He has signed up and started two court approved classes but was dismissed for missing classes. He has had transportation problems because he works at a camp in the mountains and it is 30 miles to the closest class, plus he has to go to 2 AA meetings/week, again they are 30 miles away. He has to go back to court in 2 weeks. Does he have any options at this point? Can he ask for Prop 36?
Re: Deferred Entry of Judgement
He can ask for whatever he wants to ask for.
But he should make a point of abiding by the terms of his probation. He doesn't want to blow a deferred entry of judgment. If he needs to, he can flip burgers at a McDonalds near his AA meetings and classes while he finishes up.
