Divorce and Assets
My question involves divorce in the State of: INDIANA
My stepfather has filed for divorce from my mother. They have been married 14 years. He is 64 and she is 62. First of all she cannot work due to medical conditions and has not worked enough to get social security. She can draw off of my step-fathers social security, but has to wait until he retires, and they have to be divorced for 2 years. She does not have any other income.
What are the chances of her receiving spousal support? Also is she entitled to half of the home and half of his IRA? I have heard that she is only entitled to what he contributed during their marriage, but have also heard she can get half. I would also hope that my step-father would be required to keep her on his insurance.
They live in Indiana.
Any input would be greatly appreciated.

Re: Divorce and Assets
Indiana in an equitable distribution state. Here's a link that should explain more for you.

We don't know what the chances of her getting spousal support or half of anything or medical coveage. She needs an attorney to help her out who will know the speicfics of her case. You can hope that your step father would be required to keep her on his insurance but it's possible that the court will not require him to do this.
Get her a good attorney.
