Juvenile Class 1 Felony Drug Possession
My question involves criminal law for the state of: illinois
my son has been charged with a class 1 felony for the possession of a controlled substance (60 ecstacy pills) He has a clean police record and is a 3 sport athlete at school. he is a star basketball player too. he is in honors classes and since this expeiriance wants to change his life. We have said we are open to a plea bargin in which we would give away names. He is 15 years old.Iis possible that he will come away with probation counseling and community service? He is currently on home detention and wants to get a job and start volunteering at places right away. he has repetedly said he wants to change and just stay in school.

Anything is possible.
But due to the amount of tabs he had and the fact that it is a felony, you need to ask his lawyer.
Get the best one possible. This is definately a crime you to not want on his record.
One more thing... maybe things have changed, but MY coaches would cut me from the team for something like this.

ok well do you think they would send him to a juvinile home i mean they are saying 4-15 years and he wants to avoid all jail tiem and will do everything necassary to avoid it like maximum probation maximum fine maximum community service

we arent sure yet out next date is on the 18th but i think they will charge him as a minor

I am honestly surprised that they are coming down on that hard but NOT charging him with distribution.
60 tabs should have brought charges of intent to distribute.

he wasent distributing thats the thing we are going to put him in a outpatient rehab next week so that it looks better in court

The penalty for possession of 15 - 200 tablets of MDMA is set forth in 720 ILCS 570/401:

years with respect to: (i) 15 grams or more but less than 100 grams of a substance listed in paragraph (1), (2), (2.1), (3), (14.1), (19), (20), (20.1), (21), (25), or (26) of subsection (d) of Section 204, or an analog or derivative thereof, or (ii) 15 or more pills, tablets, caplets, capsules, or objects but less than 200 pills, tablets, caplets, capsules, or objects containing in them or having upon them any amounts of any substance listed in paragraph (1), (2), (2.1), (3), (14.1), (19), (20), (20.1), (21), (25), or (26) of subsection (d) of Section 204, or an analog or derivative thereof;
Note that this does not mean he would have to get that disposition, particularly in juvenile court, but it does highlight the importance of seeking legal counsel. There does not appear to be a separate provision for possession with intent to deliver, and with that quantity expect that to be what the prosecutor is assuming.
