    Name Change for a Child with One Parent on Birth Certificate
    My question involves name change laws in the State of: Florida

    I want to change my three year old sons last name to that of my husband and mine. I am the only parent on the birth certificate, and although I was married to my ex at the time (divorce was pending), my ex is not the biological father. For all legal purposes though, my ex is considered the "legal father". The biological father knows who he is, insisted on DNA testing, but has not had any contact with us beyond giving me a notarized Affadavit of NonPaternity, which he mailed to me earlier this year.

    Who do I need to obtain permission from, the biological father, the legal father, or do I even NEED permission since I am the only parent listed on the birth certificate?

    And then, where do I start? Do I have to go to court? Can this be done through the mail?

    I appreciate any help you can provide. Thanks!

    You'll need permission from the legal father- your ex husband.

    thank you SO much. I have been asking the family law department here and they don't seem to know anything beyond how to file forms. o.O
