    Statutory Rape Law in Georgia
    My question involves criminal law for the state of: Georgia

    I looked up the law pertaining to statutory rape in Georgia and found this:

    "(c) If the victim is at least 14 but less than 16 years of age and the person convicted of statutory rape is 18 years of age or younger and is no more than four years older than the victim, such person shall be guilty of a misdemeanor."

    Does this mean that, if the person is, say, 19 years old and has sex with a person 15 years of age, then they will be charged with a felony even though they are no more than four years older than the minor?

    You'd have to read the rest of the law to know. I'm sure it's addressed.

    That's exactly what it says. Did you see this part too?

    In Georgia, if she's under 16, she's off limits to ANYONE - PERIOD. If you were 18 or younger, the offense would be a misdemeanor, but once you turned 19, the misdemeanor of statutory rape became a felony - punishable by 1 to 20 years in the state pen (if you were 21 or older you'd be looking at 10 - 20 years) and requirements for sex offender registration.

    I can tell you that it is more than 1 year for statutory rape and a closer to 10-20 for raping or molesting a child. Heck, some counties will give you 10 years for soliciting a minor!

    ...keep that in mind if she is sending you explicit text chats and explicit e-mails trying to entice you; the courts see that as you enticing her or "grooming" her. All of the major providers (AOL, Google, Hotmail) archive e-mails for legal discovery and they will turn them over. The same goes for texts. I am not sure of the duration of the archival but do know that Google has TONS of disk space.

    ...and that nudie picture or video of her prancing around in her skimpies twirling her bra in the air constitutes posession of child pornography. If you created the video on your cell phone it is creation of child pornography.

    It gets REALLY DEEP in Georgia REALLY QUICK.

    For the record, Mr. Wilson was never convicted of statutory rape. He was, however, sentenced to prison for aggravated child molestation.

    He only served two years, though.

    Think about that. Two years in a Georgia prison labeled as a child molester.

    Once in prison for child molestation, you'd probably spend so much time running and figuring out how to pick things up with your feet that you wouldn't have TIME to think about it!

    Actually if the girl is 16 in GA she can have sex with anyone she chooses as long as the male is not in a "power" position. That the way it work sin Michigan as week.

    Now say if the girl ran away from home and he says you can stay at my house only if you have sex with me and take advantage then thats when a "charge" can be brought up.

    Genarlow Wilson in GA was charged and sentenced because the girl was under 16. The girl was only 15

    I guess that would explain the charge of CHILD molestation, huh?

    The OP is also talking about schtuping a 15 year old.
