    My Visa is Expired but I don't have my Green Card yet
    Hi I have a problem and i don't know what to do, Please help me. I will try my best to explain in short story.

    I'm married to an american and we have one son and live in the US for 2 years now. We got married back in the Philippines and he petetion me with K-3 Visa "Fiancee Visa"
    When we get here in the US I found out a lot of bad things about him, that is not acceptable to me.
    Then we started to have a fight almost everyday that we started to sleep in seperated room, since 2004 we can't get along anymore

    It's been 2 years i'm staying home to watch my son. Cuz i couldn't get a job. Because i don't have a social sicurity and that he told me, i need to have a Permanent residence first to be able to apply a social security. He said he applied a Permanent residence for me. I trusted him. I just realize that I been here in the US for 2 years now and i still don't have my Green card. I realize that he been playing game on me. :( I called the Visa Center and the Person told me. Someone sent a paper to cancelled the processing to my papers. when i ask him if he sent the paper and he said He did. So now i been planning to hiar a lawyer who could help me get my greencard, But i haven't found one yet. Please help I just want to stay here in the US to be able to see my son.

    My question is:


    1. He cancel the papers, is there anything i can reapply again?

    2. My visa has already expired 2 months ago, Am i still allowed or/ Legally to stay here.?

    3. If he has another girl from the Philippines, and he want to petetion her, can he do that while were still married together?

    4. Where should i go to ask for help to my case?

    If you married in the Philippines, why did you enter under a fiancee visa instead of a spouse visa?

    You need to get back into status, ASAP.

    You should consult an immigration lawyer.

    Thank you so much for the respond. Actually we submitted two Visa, I know its kinda confusing. the first visa was a spouse Visa and then somebody told my husband "Fiancee Visa" is faster. so he submit another paper, without calling the US embassy that he want to cancel the Spouse visa. When we get here in the States. After 1 year and 6 months The US visa center keep sending us a paper for my Spouse visa that i have to go back to Manila for my Interview. Which i don't really understand.


    Yes i am trying my best to contact an immigration lawyer. But my husband keep telling me, The lawyer is asking $150 before i can talk to the lawyer and i don't have that money right now and my husband cancel the connection of our home phone so i couldn't call.


    What the best i should do??
