Getting New Charges at Arraignment
My question involves criminal law for the state of: Michigan
I was recently searched by a police officer and he found both marijuana and opium in my pocket, But since I was taken to jail nobody's said anything about being charged with possession of opium nor has it been on any of the documents I have received from the court, I have not been arraigned yet (and I know practically nothing about the legal system) Do you guys think that they are just going to surprise me with the opium charge at my arraignment or maybe (hopefully) the officer just let me go on the opium?
Thanks
Re: Getting New Charges at Arraignment
So you've been charged with possession of marijuana, but not yet with the opium? It's probably because they're waiting until they get a report back from the State Police crime lab confirming exactly what the substance was. I suggest working with a criminal defense lawyer.
Re: Getting New Charges at Arraignment
There is no way i can afford a lawyer, Im guessing they ask if you need a court appointed lawyer at the arraignment?, if so, is it before or after you enter a plea?
Re: Getting New Charges at Arraignment
As long as you plead not guilty, you should be able to request a lawyer after your plea. But do yourself a favor and contact the court to determine their procedure for requesting a court-appointed lawyer, then complete and return the petition at the earliest possible date.
