    Hit by an Uninsured Driver
    My question involves insurance law for the state of: Indiana. My auto was hit on Sat 8/2. The driver gave me her info but did not wait for the police. The police said her driver's license was suspended and the insurance information she gave was not valid. What can I do now? I do not have collision coverage on my vehicle so my insurance company will not get involved as they do not have a loss. How do I get her to pay to fix my car??? Thanks for your input.

    You sue her.

    You get an attorney, you get her address from the police report and you take her to court for the damages and your legal fees.

    You can sue for up to $6,000 in small claims court. Details are in this manual (PDF).

    Did you take the uninsured or underinsured coverage offered by your insurance company? If so then you are covered. Even though you will pay an additional premuim, you need this type of insurance. If you don't have it now, go back and add it so you will be covered in the future.

    Even if you get a judgment, it is unlikley they can pay. However, your state may allow you to have their license suspended.

    I think the other driver's license was already suspended. Hence the flight from the scene prior to Johnny Law's arrival.

    Wouldn't that be leaving a scene of an accident and getting into additional trouble? Insurance or not I wouldn't want to have to deal with two issues.

    I have been hit by 3 uninsured drivers in california.I can tell ya it is no fun luckily i have always had uninsured motorist. The only thing you can do is go to court but if they dont have insurance they probably dont have the money to fix your car so
