    Warrant Issued for Violation of Probation
    My husband was sentence to 10 yrs supsended to 5yrs probations with a $3300 fine in 1991 for 9 counts of grand larceny. (he paid $300 and did 6 months intensive probation on house arrest.) He have been to dept. of corrections twice since then 93-95 and 96-99. When he got out of jail in 1999 he reported to the probation office to see if he was in the system. The secretary told him she did not have an order for him to report so we left.
    Two years later in 2001 a probation officer came to his mother's house and said he had to report to them or they would lock him up on Monday. We had move out of the state and he had not gotten into any more trouble, so we were thinking this had to be a mistake. He reported to the probation office and they told him he had 5 yrs probation that he never started from 1991. He advise the new probation officer that this had to be a mistake and he would get all of his paperwork. In the meantime the guy violated him for not staying and put a warrant out for his arrest.
    My husband got stopped last week for speeding and they are holding him for violatin of probation from 1991 until he go to court in Jan. They are trying to give him 10 yrs for a probation sentence 14 yrs ago. Is this legal after 14yrs? (State of S.C.)

    Probation Violation
    Successfully evading capture on a probation violation doesn't make a charge go away. And that's what they think he did. He needs to retain a defense lawyer in the state where the charge is pending.
