My question involves criminal law for the state of: Virginia
I was just recently charged with poss. of marijuana. They required me to due the following:
1. probation for 6 months
2. random drug/alcohol tests
3. 24 hours community service
4. suspended license/ restricted for 6 months
5. drug treatment classes
Now my question is if/ when I complete the following will the possession charge be off my record?
This is my first offense. and i have NO previous record?
It's sounds like its not what they required you to do, but more than likely what you agreed to. We don't really have anyway of knowing but it sounds like a diversion program. The normal for VA for a first offense is misd 30d jail and 500 fine for a first time with the option of deferred proceedings. So yes it sounds like it but you really need to check with your lawyer to be sure. Tough state to get caught in! (BTW, just FYI, 2nd offense is 1 year in jail and 2500.00 fine.)
