Is There a Time Limit for Bargaining a Deal
My question involves criminal law for the state of: MI
So far I have been to the court three times after I turned myself in.
1st: preliminary exam
2nd: arraignment
3rd: pre-trail requested by my lawyer due to pending feedback from procecuter on the plea request.
I am going for motion next time. I wonder if this fails do I still have more chances barganing? Before what stage can the bargain process keep going? As the case goes on I am scared that I have used up all the bargain time.
Thanks a lot.
Re: Is There a Time Limit for Bargaining a Deal
time limit for bargaining a deal:
there are two actions that limit the time;
1. when the judge slams his gavel with a court finding.
2. when the prosecution decides they no longer wish to attempt to negotiate a deal.
Due to those two items, there is no legal time limitation but one of willingness of those you bargain with to want to bother any longer. There have been plea bargains struck while the courts were waiting for the parties to enter the courtroom for a trial.
