Non-Solicit, My Boss Wants to Hire Me Away
My question involves labor and employment law for the state of: CA
I am planning to leave my current company, and may end up in a legal dispute with them after i leave over unpaid wages/commissions. Upon telling my boss (VP who i have a good relationship with) that i am likely going to go to company X pretty soon as a courtesy, he disclosed that he is going to company Y and we would be competing against one another. He suggested that I speak with his prospective new employer so maybe we can work together. I have offers from both company X and Y.
I am wondering if my boss has signed a non-solicit agreement with our current employer, would how this went down maybe be a breach of this and if so, would the breach only be on him since i cannot solicit myself to leave? Typically they only cover your soliciting someone else, not conspiring to have someone else solicit you - and we really didnt conspire either, as i was going to leave anyway hence the offer from the other company...

And you expect us to be able to interpret the legality, enforceability and terms of an agreement that not only we have not read, but that may or may not even exist?
