    Can I Get My Record in Retail Cleared if I Am Not Convicted?
    i was caught shoplifting, and police came and they report it to court. But the court decide not to prosecute me.i guess it's because there is not enough evidence. so i am neither prosecuted nor convicted.
    in this case, can i ask the store to remove my name from their database?

    As you were told when you posted, laws are different in every state.

    Ask away . . . the store has no obligation to remove you

    Since the criminal penalties didn't happen, did you pay a Civil Demand?

    no,, i didn't. they sent a letter to ask me pay, but i didn't. i am not convicted, and i have never admit i shoplifted. so i didn't pay.

    Now you have a bigger problem, and one that won't just go away easily

    You could have made things go away by paying the civil demand

    since i didn't sign anything in the store, because i don't think i shoplifted, i don't think i need to pay. if i pay, means i admitted. so that's why i didn't pay.

    they ask for civil demand about three months, i didn't pay. and nothing happen after that.

    by the way,things happened like this,

    that day, i concealed staff but never left the store, then being stoped by LP. since i don't admit, they called the police. police come, they checked the video. the video doen't have anything for me steal. and i didn't leave the store either. in my state, i don't think concealment is a crime.

    police give my detail to court, and court decide not prosecute me. then i get the civil demand from store. i don't think i shoplifted, so i didn't pay. it was 4 months ago. and nothing happened after that. should i worry?

    Failure to pay Civil Demand can cause you serious expensive problems. Just ignoring can cause trouble try to get this resolved

    Said OP has no obligation to pay the civil demand as he is not guilty of any criminal charges. Anyone can send you a civil demand letter, but whether it gets paid its a different matter.

    He was not found "not guilty" DA chose to not press charges theres a difference. Besides just because he not guilty does not make Civil case nonexistant. Example OJ Simpson was found not guilty or murder but was found civilly libel for the deaths of same two persons. OP needs to clear this up before it goes on credit report or winds up in court
