    My question involves labor and employment law for the state of: CA

    Are police records and reports that didn't result in being sent to the DA, and that didn't result in charges or arrests seen on a background check, one for medical jobs.

    It's possible. It's according to how thorough of a background check the employer does. Some do a more thorough one than others - it sometimes depends on the job applied for.

    it's a hospital job as a health professional.

    In most jobs apps i am asked about convictions, but authorize to contact courts and police agency to inquire about my "background".

    I always told that you're innocent until proven guilty. But, anyone can go to the police and make a report about you and you will have to have that on you for the rest of your life affecting you in a negative way. So unfair to me. Makes me want to stay home.

    Innocent until proven guilty only counts in a court of law. Not in employment.

    Hospitals usually do pretty through checks, but no one here can tell you how thorough any given hospital will be. Nor can we tell you how much weight any employer will give any given information.

    I am not a lawyer nor do I know much about this, but can someone explain how an employer can access this kind of a file, please

    From my research, background agencies like Choicepoint and Kroll go by FCRA, which limits their info to convictions. They check courts, but this report never made to district attorney or any court.

    Live scan, checks RAP sheet, records of arrests and prosecutions with department of justice and FBI. I should have neither of those.

    Are you saying an employer can go to every single police agency in the county and ask to see every single record on me?

    If they want to, they can. There's nothing in the law prohibiting it.
