    DFS Sent My Daughter's Medical Records to Her Ex
    My question involves child abuse or neglect in the State of: Virginia

    My daughter got a copy of a letter in the mail today from the country attorney to her ex-fiance (the baby's father) and his attorney telling them that they (DFS) are submitting as evidence to the court 150 pages of my daughter's medical records, and that a copy of those records is enclosed (now my daughter only got the LETTER but her fiance was sent a copy of HER MEDICAL RECORDS!). Can they DO that? I mean I know they can submit the records to the court, but what gives them the right to give those records to anyone else?

    Were the documents included in the discovery documents for some reason?

    I'm sorry, I only know what the letter stated -- the documents are being given to the court as evidence in CPS' investigation of my daughter for statements made at the birth of her baby. My daughter's medical records are no business of her ex-fiance.

    They are if they are evidence in a trial for some purpose.

    Now, having said that, the instances where such records are put into the court records are pretty well defined and confined.

    what is the significance of the records to your ex?

    Because her ex-fiance is the child's father and there is a question concerning your daughter's mental state/fitness as a parent- yes, the records can be introduced and they are the father's business.

    Does your daughter have an attorney? If she does, she should speak to her attorney about the situation.

    Lance not to be rude but you seem to have many cps related issues. You have started 8 threads counting this one on various topics related to cps. I thought I had seen your name before so I clicked your profile and then all threads started by you. I found 8 all on cps topics

    Her daughter is bi-polar and made a comment that she was afraid of having a problem with post partum depression. Apparently that is what started this whole thing. If the daughter is stable on her meds and has seen her Dr and therapist regularly, the medical records should provide proof that she is mentally stable.

    Lance- you really should keep all of your questions in one thread, it'll make it easier for us to remember the entire situation.

    Further, that would be one of the instances where it would be not only proper but advisable to admit the pertinent medical records in court.

    You cannot hide the medical records of a mother that may be medically unable to care for her children.

    Then it might have been wiser to keep it all in one thread since they are one case. The way it is it appears as though you have habital problems with CPS. I told you I wasnt trying to be rude and I admit I have not read all 8 threads
