Minor Posession of Alcohol In Texas
My question involves criminal law for the state of: Texas
I am a minnesota resident but recieved a Minor In Posession of Alcohol while visiting in Texas. I was at a party for five minutes when the cops came. I had no intention of drinking because im a minor. I was not offered alcohol nor did i bring or drink any. The officer gave me a ticket just for being around alcohol. How is this condsidered posession? In minnesota a minor can be at a party as long as they have not been drinking, so I was shocked when I recieved the citation. What will the punishment be like and why did I get a citation for posession?
Re: Minor Posession of Alcohol In Texas
The punishment will likely be a fine and an alcohol awareness class.
As far as why you were cited, Texas law requires that you be in the "visible presence" of your parents to be where alcohol is being served. (You can also actually have a drink under this provision, too.)
Since your folks were not with you, you were cited.
