Removing Paternity Rights
I am in Florida. My son (Chris 5 1/2 years old) is disable with Digeorge Syndrome. His Father, who I was never married to, filled out the birth certificate at birth since I was very sick and unable to. He gave Chris his last name and not mine.
This man is now in jail for the past 5 years (yes, Chris was only 2 months old) for sexually abusing my daughter who was only 6 years old at the time. He received a 16 years sentence and 14 years probation.
Chris needs a lot of medical care and I can not stand calling him by his bio-father's name or have the doctors calling me by it. I am also having problems with medical care because they sometimes need the consent of both parents for some of his procedures. At the end of next month he will need open-heart surgery.
He is also coming of age that he wonders why he does not have the same last name as his mom, brother and sister. The bio-father has no communication with either one of us.( I wanted it that way)
I want to remove his parental rights and also change Christopher's last name to my last name. Is it possible? And how would I go about doing it?

Under the circumstances, it might be possible, IF your child is not on medicaid or some other FL public assistance. However, this is something that is best done with the assistance of an attorney to make sure no mistakes are made.
