    Im 15.and Want to Be Emancipated
    i need help. I want to become emancipated but im a 15 year old girl and i have no job because of my age and location. i have read up on some of the rules like how you have to be 14 and how you may have to pay a fee. but i know my mom wont sign the papers and my dad is no longer in my life.

    the reason behind the emancipation is because my mom emotionally abuses me. i know this totally sounds fake but it is true. she doesnt know how to raise a teenager. whenever i come home with a bad grade she tells me that i need to do better and grounds me...which has no affect because she refuses to help me with my studying. she gives me no moral support. i have been called stupid and dumb. and when i show her my designs she sticks up her nose, doesnt say thats good, but she says it looks stupid.

    When I have a boyfriend, she says it wont last...ike now i have a boyfriend of 6 months and things are going great...but my mom insits on keeping us apart and she never wants to drive my anywhere...although she says she likes him.

    im just so sick of crying myself to sleep wondering if ill ever live a better life. because of her i used to cut...when she found out she didnt ask why, she just said dont do it again or your going to be "sent away". She never sits down and talks to me. and whenever something happens at the house its never her fault. its always me or my 10 year old brothers. she wonders why i never talk to her about my personal life...its because i know what she'll say...itll go something like, "oh thats a stupid reason to do that"

    im so sick of living this way. somebody please help me.

    Get a full-time job, support yourself 100%, and move out.

    Then you will be emancipated.

    thats going to be very hard. i do want to go through school. and i cant balance both a full time job and school. plus if i moved out id probably be reported as a runaway...

    Who did you think was going to support you when you were emancipated?

    Until you can answer that question, nothing else matters.

    When you have a sustained income in excess of 1200 a month (take home), come back and we will talk more.

    Oh, and start looking for an apartment to move into. Tomorrow.

    And you are correct, no one will lease an apartment to a 15 year old. Good luck.

    Nothing in these two paragraphs is illegal, immoral or inaccurate. In fact it appears to be good parenting

    In some jurisdictions yes, in others, no.

    However, you still have to make enough to support yourself if your roomate leaves or you move out.

    You see... judges want to make sure that the children they give the rights of adults don't end up a burden to the state.

    In other words, if you can't pay your own way, you stay with momma.

    Judges look for a reason to deny a petition of emancipation.

    You haven't yet said anything APPROACHING a valid reason. All teenagers fight with their parents.

    All teenagers think their parents don't understand them... including MY 15 year old.

    Not a valid reason for emancipation.

    Emancipation isn't for children that WANT to get away from mommy and daddy. Emancipation is for children that NEED the rights of an adult to survive.

    You don't.

    im not trying to sound all dramaqueenish but if i stay here tings are not looking good for me. she can barely support me now anyways...truthfully itd be better if i left now because later itd be too late...i can get more loans for college if i move out...i may actually be able to afford the things i need...such as new clothing

    And you still haven't given a valid reason for emancipation.

    Your on crack right!? You have no clue and besides all your argueing with us gets you nothing. The law is the law. Your emancipation dream (thats all it is ) isnt going to come true period!

    Fighting with your mother and she not putting your artwork on the refrigerator doesn't come close.

    AND, if you have been cutting in the past, that is all a judge needs to hear. No judge is going to give a child with self destructive tendencies LESS supervision.

    I recommend family counseling.

    As I already told you if you think your being abused contact CPS their National Hotline (manned 24 hrs 7 days a week) is 1-800-4-A-CHILD

    My parents are moving and I don't want to go.

    My parents have too many rules.
    I want to live with my dad instead of my mom (or my mom instead of my dad).
    If you are being abused by your parents, you should report the abuse to the authorities. 1-800-4-A-CHILD.

    Most emancipation laws require you to be financially self-sufficient. That means you must be able to support yourself at the time you bring your petition for emancipation. It does not mean:
    I will live with somebody who will support me.
    Once I'm emancipated I'll be able to get a job and then I can support myself.
    I'll apply for public assistance after I emancipate.
    Pregnancy will not emancipate you from your parents.

    You will be entitled to make your own decisions concerning your medical care and the care of your child, but otherwise you will remain in your parents custody.

    As if you are pregnant you need to be able to support not only yourself, but also a child, the chances of becoming emancipated if you are pregnant are vanishingly small.


    "The law isn't fair. Can I get emancipated even if my state's laws say that I can't?"

    Your emancipation rights arise from state law. If your state doesn't allow you to emancipate, you can't emancipate.

    "What if I file for emancipation in another state?"

    You have to petition for emancipation in a state of your legal residence. You cannot emancipate in any other state.

    "If I argue with people who explain the law to me, will I be able to emancipate?"

    No. Arguing doesn't change the law.

    You didn't think you were going to be able to do this without telling a judge in court that your mother isn't the best place for you to live without her being there... did you?
