Wanting To Emancipate Without Any Chances of Failing
My question involves emancipation laws for the State of: Tx
Im 16 in five months i will be 17 im currently not living with either parents. My mom and dad are devorced my mom has custody. i was kicked out a year ago and would not come back so she reported me as a run away. she kicked me out again 2 or 3 months ago. i have not been supported by her since then i have a job. im about to move into a house where i will be paying rent. i am currently living with a freind. My mother has stated multipul times she is not going to fight me on moving back in because she knows i will do every thing within the law to not go back there. i have thought about other options but im sure this is for me. my mother cant afford to take care of me anyway she spends everything on weed. i have many reasons i shouldnt live there that im sure a court will agree with that i dont think i shoud have to post. but i need medical insurance and to be able to sign myself into school. So Is there any advise i can get before i go threw with this.

Pay attention in English class, because if your emancipation petition is spelled as poorly as this post, the judge isn't even going to wave at it, let alone look at it.
You currently do not meet the Texas requirements for removing the disabilities of a minor.
You need to be living completely apart from everyone - alone, no roommates, no staying with a friend - and supporting yourself 100%. That means paying all of your rent, utilities, health care, groceries, savings and the like completely by yourself. You also have to stay in school - and do well - and conduct yourself 100% as a responsible adult would. And you have to be able to document all of this to the judge's satisfaction.
You have to have all of this in place before you even attempt to file the petition.
I am not unsympathetic to your situation. It's very difficult when the people who are supposed to take care of you until you can take care of yourself suck so much. But you're not eligible yet.

I'll repeat my long-standing position that it's possible for a judge to find a minor capable of self-support even if the minor has a roommate. As others point out, though, the judge will want to know that a minor's ability to support his or herself will continue if the roommate moves out, kicks the minor out, or stops paying rent.

So if I am living on my own. Have a job, support myself, and am going to school i have a better chance. basically all I need to do is prove that i can support myself and this is the best thing for me. right? Also is there anything i can do because school is about to start and my mother wont go regester me, and the only reason i have not moved out of my friends house yet is the owner of the house i would be renting is waiting for me to get emancipated could i take that to the judge to show i have a place and i can afford it exc.

First I'm so sorry that I can't spell.Don't you think I am a little smarter than to write like that on the patition. Getting emancipated will be determining my life I think It's a little more important then posting a thread on the internet!

Having a place lined up for the Judge may not work, you haven't live there, you have no idea the amount of bills you will have, you haven't the foggiest idea of what is going to cost what. What kind of budget do you plan to show the judge?
You may not think how you spell on an internet forum matters much but the way you conduct yourself actually does. I'm not sure even what you meant by that, are you saying you purposely spell poorly and can actually spell correctly?
As for getting signed into school which starts in a matter of weeks you will have to contact children and youth in your area, even if you qualified for emancipation it won't happen before then.

So what if i can show about how much the bills will be and my budget and how i plan on handling it?

What I was saying is no Im not the best speller but if I actually sat down and was worried about it then yes I would spell alot better. I was more worried about asking the question then anything.

Judges look for reasons to deny emancipation applications. It is far, far more likely that you will end up in foster care or as a ward of the court than that the judge will approve an estimated budget.

How can you make a budget of what your bills will be if you have never done it? YOu can't exactly look off your parents bills and work from that.
How much is groceries going to cost you a month? How much elcectricity are you going to use and what is it going to cost? You say you want to rent a house? An actual house, like more than one bedroom? Are you aware of how much it's going to cost for something like that? Rent isn't the only thing you need to look at.
Do you even have the money for moving fees, security deposits for your utilities? I'm guessing this is all based hypothetically since you didn't exactly mention if you have a job or what. Without a longstanding job history that pays enough none of this even matters. (The part about the budget)

I've never written a household budget, yet somehow I manage to support myself. ;)
