Divorce for Veteran Whose Husband is Active Duty Living in Italy
My question involves divorce in the State of: Tennessee
My spouse and I were both active duty military when we met, both living in Aviano, Italy. We married July of 07 in TN (I am a legal resident). I have just separated from the military, and my spouse will be staying in, and staying in Italy until May 09. We now wish to get divorced, and I am very lost as to what my options are. The legal office on base will not help us.
We are both in agreement of the divorce,have no children and don't own a home. We don't even have a bank account together, so I think this will be a fairly easy process. I have not left Italy yet, so I don't have a job to pay legal fees for an attorney. We have both agreed to draft an agreement stating which property is mine and what I am taking with me, etc.
I thought about flying to TN and filing for divorce there, but will he have to fly to TN also? or could i just send him the papers and be done with it?? I am so lost? please help!!

Since you just seperated. But yet you are married still to an active duty member. You need to look into spouse services on base. Or have your husband go ask base legal what needs to be done since he is still active duty. If they refuse him service. Have him talk to his first sargent or who ever he falls under. I was in the Marines so when we needed help with anything it was the Company First Sargent.
Also if you were discharged honorably you may want to talk to the VA about legal assistance as well.
But since you are not contesting nothing. If you return to TN all that should need to be done is you have the papers drawn up. Send them to him have him sign them and get them nortarized, send them back to you and then you sign and nortarized, then send him back his copy of the finalized document.
