Infraction for Public Disturbance and Job Applications
My question involves labor and employment law for the state of: California
Hello,
After a plea bargain with the DA of Santa Barbara, I received an infraction for distrubing the peace or something along those lines instead of a misdemeanor drunk in public. (I had a background check run by the FBI and it didn't show up, only the original arrest for those who are interested by the way). At any rate questions on applications that I've been seeing frequently ask if "you have ever been convicted of a crime." What should I say? Also, since the last time I had to apply for a job, I feel like the background checks and personal history that they ask for is much more invasive (ie using investigative consumer reports which may include public information including arrests); are people exploiting loopholes to aquire this information now even though it seems like it shouldnt be legally allowed for use to base an employment decision on? Thank you in advance.

Never, ever lie on a job application - if you do land the job and the infraction comes to light later, you can be fired immediately.

Civil infractions are usually not considered crimes (e.g. Maryland), but some states call petty misdemeanors infractions, even though they are considered criminal acts that show up on your record. So there are such things are criminal infractions.
