Petty Theft in California
My question involves criminal law for the state of: California
Dear members,
Two of my friends and I (18+) went to Target to shop, but we ended up shoplifting. However, one of my friend and I were reluctant to do so since it was our first time. My other friend shoplifted before. Anyways, she made us steal something and we did, but we were caught. There are numerous evidence to prove us guilty. I talked to a lawyer, but he wasn't much help. He told us that we should trial as individuals because my friend (who has shoplifted before) is the ring leader. I stole some of dvds, and I'm not sure what the worth of the items were, but I am pretty sure it was less than 50. Now I am nervous because the attorney said that there is a possibility I can get kicked out of school. This is my very first time of being charged of anything.
Should I plead guilty?
What are the possible sentences?
Will I go to jail?

What did she do? Tell you that she wouldn't be your friend anymore if you didn't commit a crime? No, she did not "make" you steal. You did that of your own accord, now it's time to pay the piper.

Depending on your school's policies, you very well could. Some schools have "honor codes" that require booting criminals out the door. You may find it difficult to obtain a job in the future as well, particularly in the retail or banking sectors.
You're looking at a misdemeanor charge, restitution, a fine of around $200 and a maximum of one year in jail. First offenders rarely get jail time, however, and you may be eligible for a diversion.
Go back and talk to your attorney again.

I have a question about diversion. Is it something I would request on my court hearing or is it up to the judge to decide?
