Arson for Insurance Fraud
My question involves criminal law for the state of: Indiana.
I was convicted for Arson with intent to defraud insurance (Took a plea to avoid a BS trial I knew I would loose) Anyway, I got a year incarceration & 2 years of probation. Because it was a small town, I had probation transferred out of state to NJ. My question is 2 part, 1) Can I get a PCR or something similar? I would like to get the felony dropped, but if not, at least reduced to a misdemeanor so I can go back to working in health care. 2) If I can get it done, does it have to be filed in IN & if so, do I have to appear or can it all be done through NJ courts, since that is where my probation was transferred to? Felonies are notoriously difficult to get expunged.
Getting the charges reduced would rely on several factors including how long it has been since the crime occurred and your record since then.
If you just got out of the joint, you are going to have to wait a while.
