H1b Visa With a Class C Misdemeanor From Texas
I'm working in US since October 2007 on H1b visa and I never had any convictions or even single speeding ticket before.
Yesterday I was celebrating July 4th with a friend of mine by playing with fireworks, and eventually a cop show up to stop us and give us ticket for "discharging fireworks within city limits" and the fine would be around 120$. I live in Texas.
I'm going to meet District Attorney next week and I hope i can pleaded not guilty, since :
- I bought the fireworks from the local stores and no single postings about prohibiton of discharging fireworks within city limits.
- The Cop did not see me discharging fireworks, I just holding it on my hand
- The Cop trespassing my private property (my backyard) without notice from court..
My Question is: If i pleaded guilty and I pay the fines.. Can I have problems when I want to renew my H-1B stamp? I have to go back to my country this October, thus I have to re-stamp my visa..

I doubt a Class C misdemeanor will much affect you, but you should consider seeing if you can get the charge dismissed or, at the very least, try to get a deferral.
The police may enter land to investigate the ongoing discharge of fireworks from that land.

I just talked to District Attorney and he still fine me 101 dollars and he gave me "90 days deferral". He said that to answer the question:
Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty or other similar legal action? Have you ever unlawfully distributed or sold a controlled substance(drug), or been a prostitute or procurer for prostitutes?"
at my immigration paperwork, the answer should be "no" if the question asked 90 days after today..
Does he made a valid point about that? or i should check "yes" on that particular question ?
