Used Blazer Sold "As Is", and Engine Blew 14 Days After
My question involves a consumer law issue in the State of: OHIO

We bought our son a 1996 Blazer on June 16, 2008. It was at a "Buy Here, Pay Here" dealer because our credit is not good due to a bancruptcy and we did not want to spend 10,000 on a guaranteed loan as a fist vehicle for a 17 year old. We paid the down payment, tax and title, along with a warranty that the dealer offered. It was a three month warranty that covers up to $1000 dollars. We made the first payment, and the second payment is due in 4 days.

On June 29, (the 13th day) it would not start and had to be jumped. On June 30, (EXACTLY 14 days from date of purchase,) It would not start again, we had to jump it, then as he was drvind to wrestling practice, it stalled on the high way. It took several jumps after several stalls to get it to safe location. We contacted dealer, who was on vacation, and was told to contact warrany people. We contacted them and they told us to find a garage and they pay up to $1000.

We talked to several garages, and had to have it towed because it was undrivable and making a terrible sound along with the engine "bogging down". We have been told we cannot drive it off garage's lot or engine WILL Blow. We are being told it needs a new engine. We are being told around 3,000 out of pocket.

We realize we bought as is. We realize we payed $5000 for a vehichle that would have been around $3000 somewhere else, but do to our circumstances, we had no choice. But is there some kind of implied warranty in OHIO that a vehicle should last for more than 14 days? My son has not did any joy riding in this vehicle. He has driven it to school for wrestling practice, to work and to his baseball games only. In the 14 days, he has put a little over 200 miles on vehicle.

The second payment is due in 3 days. What do we do? Do we make the payment? Are we stuck with this vehicle. Can we make them fix it? Exchange it?

I have looked at several sites, looking for anything that will help us. There are a few things that also has happened. I noticed on one site, it said the buyer disclosure placed on the window has to be filled out completely and correctly, "No, if, ands, or butts." It said the dealer's name and adress and phone number had to be filled out on back. On ours, the only thing marked is the "As Is" box, nothing on the back is filled out.

Also, he said he was selling it to us for $3995.00 selling price and filled this amount out on several of the forms. After closer inspection, the "Retail Installment Contract" staes we cherges $4,218.81 even though the Bill of Sale shows $3995. Does any of this help our situation? We do not have a problem paying for it, as long as we have an operational vehicle. Certainly, it should last more than 14 days.

PLEASE, PLEASE, PLEASE, help. We need to know what to do. We need to be making the payment.

What does the warranty include? If it doesn't include engine work you may be stuck fixing it yourself and continuing to make payments.

It does include the engine but only up to 1000. Does any of these other issues make a difference?

The problem being what? Was it out of oil? Overheating?

We don't know what the problem was, nobody seems to be able to tell us what caused it. All we were told was that it needs an engine. And no it was not out of oil and it did not overheat. I t just kept stalling out and then it had a terrible pinging and clinging sound from the motor ad the check gages light came on. It wasn't getting any oil pressure even though there was oil.

It was an OHIO LEMON LAW site

When a car isn't getting oil pressure, you don't drive it. No ifs, ands or buts. If you drive a car with no oil pressure, you will destroy the engine. It sounds like you turned an oil pump or gasket failure into a total engine replacement job.

The site uses the word "may", not "will". I doubt that the omission of the dealer's information from the back of the form will help you, given that you know who the dealer is and where they're located. Also, the site indicates that the remedy would be rescission, which doesn't necessarily help you as that means you're each supposed to be restored to your original condition - and returning a broken car doesn't do that.

The law firm behind that site claims to specialize in these issues, and says "If your used car turns out to be a “lemon”, the odds are that Ohio has a law that can protect and help you. To find out more, contact us.", so I suggest trying that on Monday.

It was NOT drove after it was losing oil pressure except to get it off the road where my teenage son had broken down. As soon as it was off the highway, it was towed and hasn't been drove since
