    HOA Right to Verify Tenants
    My question involves a condominium located in the State of: Illinois

    Our condo complex has a rule that states only person(s) named on the lease are allowed to rent/occupy the unit. The owner of the unit must also provide criminal background check of each person 18yrs and older who are on the lease to the HOA.

    There are two units in my building where there are several people whose background check has not been submitted to the HOA.

    HOA says that they do not have the power to go to those units to verify the status of the occupants.

    Is the HOA being truthful or just lazy?

    If an owner isn't complying with the bylaws, the HOA can seek to impose against the owner whatever sanction the bylaws permit. That doesn't mean they can barge into a unit and demand that everybody provide photo ID.
