    First Time Shoplifting in California
    My question involves criminal law for the state of: CA

    Background:
    One of my family memebers got caught for shoplifting in CA. She is an adult. Items involved >$1000
    She had no intention to shoplift as she didn't conceal the items and cut the tags at all. She took things that she didn't need. She didn't know why she did that. She had depression record in the past. She has only been in US for a year.

    Action plan:
    1. Get medical record
    2. Talk to psychiatrist
    3. Sign up National Assoication of Shoplifting prevention online class
    4. Get a lawyer

    Questions:
    1. Since she is new immigrant, who is under stress trying to fit in not to mention having depression in the past, would all these be considered and result of a less sentence?

    2. If we did all the above action items, what is the chance to have this charge reduced to misdemeanor?

    3. What is the most likely result? Deferred sentence? Any chance to ask for expungement?

    4. Any other possible things that she can do to enhance the chance of having a less severe sentence?

    The aforementioned excuses have been heard by judges countless times. Talk to your Attorney

    I am guessing you exceeded felony amount. Diversion is very unlikely but ask your Attorney
