    Minor Name Change In Missouri
    My question involves name change laws in the State of: Missouri

    My son does not have his father listed on his birth certificate. He has the last name that I was using at the time of his birth which is not my current or maiden name. What would be needed as far as parental permission?

    Do you have any contact with the child's father?

    If no, when was the last time you had contact?

    I haven't spoken to his father in 10 years and then only one time prior to that when he was 2 or so. He is 16 now.

    The notice provision follows, although I suspect that if paternity has never been established you can proceed based upon the assertion that you're the only known parent. Note also, when your son turns 18 he can change his name without any requirement for parental consent.

    When a minor files a petition for change of name the written consent of each known parent shall be filed. If the written consent of each known parent is not filed, a copy of the petition together with a notice stating the date of the hearing shall be served on each known parent not consenting not less than thirty days before the date of the hearing. The service shall be by registered or certified mail addressed to the last known address of the nonconsenting parent. Service shall be proved by the certificate of the clerk that he has mailed a copy of the petition and notice by registered or certified mail.
