Stole from Work for Drugs
My question involves criminal law for the state of: PA
The short of it:
I was a very very liked person in an auto company that put them on the map.
I was friends with the owner and he was very proud of me and quickl moved me up in the company.
My fiance left me for no good reason four months ago and my world fell apart - someone gave me oxycontin to sleep and quickly i became so addicted that i could have stole more than 10,000 to pay for my 500/day habbit.
i cooperated and admitted to most and have offered up the dealer.
detective investigating promised and ARd since i have no priors and i should have all the money to pay back right away....
im so scared - i am building a site on oxy abuse as i cant believe what it turned me into - im doing rehab as well...
can my lawyer keep me out of prison?

If the detective keeps his word, or more correctly if he keeps his word and the prosecutor goes along with it, ARD would keep you from going to jail or getting a conviction.
Somebody gave you Oxycontin to sleep? As if actual sleep medications aren't addictive enough?

my employer does indeed know about it. they are finishing the investigation. so this is what i got going for me:
1) investigator promised as long as I cooperate and admit it he will push ard on the case
2) i am helping to give up the dealer with police
3) can pay back a lot of the money up front
4) building currently a website devoted to oxycontin abuse - i feel i need to do this for other people - im not your run of the mill criminal - i just got really depressed and got on drugs and darkness took over for four months
5) going to meetings/rehab everyday to make sure im ok - which sssssssfabulous - the people are great.
6)i have evidence of trying to get clean two months before they found out showing that i acknowledged i had a problem and was trying to fix it.
7) again no prior criminal history - only couple tickets for speeding
i want to be honest with them as its the right thing to do and i did already acknowledge on camera to them of part of the theft as well as talk ARD on camera as well.
thanks for all the input folks - just a nice guy that fell into such a horrid depression.

nooo the detective said if i cooperate with investigation he'll push ard on the theft - i have no drug charges....

update:
had a meeting with my former employer, my lawyer and the controller of the company - they had me review different documents of evidence...
i at this point am 100% sober and 1,000,000% willing to comply and tell the truth - my problem is this - the victim has compiled a SUBSTANTIAL amount of things that werent even taken by me - i mean about 60k more than i see on these docs that i did - my lawyer advised to take the brunt and accept full responsibility - but i mean seriously 60k more? they have no proof that i did that and i know in my soul i didnt - question is would there "extras" hold up in court? with no proof>?
i know ive done a horrid horrid thing, but two wrongs do not make a right - i can make full restitution for what i see what i know i did - but to tack on that much i feel is just as bad as what ive done?
lighter side i have no been charged with anything yet - so i guess what im looking to know is does my lawyer and i have the right to prove all things i didnt do? i feel the lawyer doesnt want to - but i cant make up that kind of money anytime soon - just looking for a button to press with my lawyer....

You are stating that you stole $10,000 and your employer claims you stole $70,000? What documentation did they provide demonstrating the amount of the theft?

Sounds like you were not the only one dipping into the corporate cookie jar... you are just the one that gets to pay the whole bar tab.

On the bright side...you have at least one good thing going for yourself. Your "girlfriend" is not in the picture...if she can get you hooked on drugs, just imagine what she would have done to you (or any off spring) if you had married her? Hang in there and keep doing what your doing...staying clean. Also feel free to PM me on the site your working on...I know someone who could benefit from it.

I have a question; These pills retail for approx. SIXTY CENTS per pill in the generic form. If you take the NON generic they are approx $1.20 per pill.
More then 6 pills a day and you would end up dead.
If I do the math the pills would never cost more then $10 per day. So how on earth did you have a $500 per day problem?????????:confused:

There is a large difference between retail and street value.

OK, I guess. I deal with mostly drug thefts so when I see these cheap pills being sold for $100 each it even shocks me.

The dosage here would also make a difference. A $500 a day problem is nothing these days. Bad addicts with an oxycontin addiction usually go by mg per day as opposed to $ value. It's not real easy to get your hands on. (drug was made for hospice care). Hardcore addicts average between 250-500mg per day. If you don't have a good connection, a 60mg a day habit could run you 500 a day.

It's not necessarily a "mark up" as much as it is a business opportunity. If he's jones-in bad enough, you can hold out and get what you can. This guy was obiously willing to steal so I would assume the "dealer" would encourage him to get the money. He's a realitivy new addict so I'd be willing to bet someone was ripping him off big time. The risk that the dealer has is that unlike regular "street drugs" this is a highly controlled narcotic the one must have a prescription for.

I hunt down and arrest people who commit felony drug thefts. I knew there was a big profit in RX drugs on the street but I never knew someone would pay that much for a Hydrocodone or anything similar.
Mostly employees at drug stores swipe the pills by filling 800 mg Ibuprofen instead of the Hydrocodone. The poor people who need the stronger drugs end up going home with the Ibuprofen. That is how many of these drugs get on the streets.
And of course they all figure they will never get caught and they just end up on here all worried after they are caught.

I get stuck trying to fix the poor souls who go into liver damage from the stuff. I currently have been watching a 21 yr old spend this week fighting for her life because she's in complete liver failure...won't qualify for a transplant cuz she's an addict. Too young to even get it and obilivous to what is going to happen (most likely that she will die within the week unless things start to improve). So very very sad.
She had a $700 a day habit and is on welfare...where did she get the money? All kinds of poor suckers out there I guess.

Well we can only save the world one person at a time. For you, you help them medically. For me I get the felons into federal prison. I am not sure I should be posting all this on this thread but oh well.
Debating the issues would be more appropriate.
If the sources of these drugs didnt exist then we wouldnt have all these drug users and a hell of alot less crime.

I'll leave the saving the world stuff to you. You all have a better chance of fixing it than I do. I prefer to stay off that hampster wheel. Just stay safe and keep up the prisons full for us would ya?

Sorry buddy, I'm with her on this one. Do you HONESTLY believe incarceration is the answer? Are you this blind (no offense)? Drug addicts have a legitimate MEDICAL problem!!!! These issues are best addressed by DOCTOR and NURSES - not ARMED GUARDS!!!! HEY, I KNOW!!!!! Let's incarcerate cancer patients as well!!!!

it was strange - they had everything they accuse me of on the table - and i ok'd the things I did - each and everyone - these docs had proof from the cust they paid cash and i acknowledged - im def a piece of crap scumbag for this and will owe up to it. but then they have these stacks - they are hitting me with invoices that i voided that didnt even involve what i done - almost like they didnt research it - they have no proof from anyone i took cash and i mean everything i did was in 100.00 or 250.00 even transactions - i didnt take headlights and body parts.. (auto business) - i pulled my lawyer aside and im like " i didnt do at least 1/2 of this stuff and he wants me to accept responsibility - that would be great if i could come up with 90k but i mean woooa coming up with the 2k i have right now was hard....
so i am so so so scared as my lawyer wanted me to get like 20k together and its turning out to be hard - i have a great job lined up making 18/hr - but i cant take it if im going to jail..
so with a clean record and the history of my case - is there anyone who believes ill get a chance to make this right - i want to work hard to first pay them back - and then get my own life back in order - are jusges that forgiving? i just think ill fall apart in anymore then 6mos of jail and am so sosososososos scared...
gigrle - ill send a pm soon - just on the fly - but yes your so right - i dont want to blame anyone for what i did but i can say your influences can really affect you - ive learned and sobered up so straight and am appaled at myself - that drug is terrible - and unlucky for me should never be abused - it ruined my life :(

update again:
i talked with the investigator and he is claiming if i get a chunk of $$ down like 20k - that my ex employer can push for this to be a misdameanor? is this possible or is he pulling my leg?

I agree with OhMy and thank you a 100% - he/she is after the people that do this:
goto Philly - get 100+ Oxy Brand Name 80mgs. Come up here and sell to me for 70/pill -- but what he would do is front me 10 of them and i only give him cash for 3 of them - this girl i was with had a problem as well and it seemed everyone i knew. So all of them would be gone in a day. Next day I get threatening texts saying "I know you steal from your work - i dont give a f*ck what you gotta do get me that money" and being scared and withdrawn youd do anything for these - dealers have addictions too and they feed off the stupid (hence my name) to get their own fix. This doesnt make my crime right but i have to say it highly influences you once your hooked.
so yes get those bastards - these guys are hooking people and staying behind the curtain - and need to be drug out and be beat.

There is a HUGE differience between alcohol and RX drugs. You get sick when you drink and you can drink only so much. However, with Hydrocodone, you can just pop an extra pill and 30 minutes later you are dead. I really do not see how anyone can compare alcohol to RX pain killers.
Larger crimes are inside jobs, those are the ones I go after, not the small time sellers or users that is the STATE's job, not mine.
Do I think that prison is the answer for someone who hijacks 5,000 pills? HELL yes, the federal prison system is designed for those people, among others:rolleyes:

The only thing I can tell you is to listen to your own lawyers instructions.
In time, this will all pass, whatever the outcome you will put this all behind you some day. In life all you can do is live and learn. In time you can look back on all this and remember it so it does not happen to you again.

i understand your feelings and as an ex-addict now i really do appreciate people like you.

If someone drinks enough of Alcohol in a period of time could easily die from it, from alcohol poisoning of the brain, or asphyxiation. Having one more drink is the same as playing Russian roulette when taking oxy or fentanyl as a recreational drug, it could kill you in the end.

Yes I do agree with you, however, you usually pass out before you can get that drunk. Again, I dont drink so I am just going by what I am told.
RX pills can work very differiently. If someone takes one Hydrocodone and doesnt feel anything from it, they make take 2 more in 15 minutes not realizing that it takes up to an hour to kick in. Then 30 minutes later they are dead. These pills are designed as pain pills, not a good way to get high.

Agreed. The average person can get drunk and pass out (whether they are regular drinkers or not). Your body has a way of shutting down. With Oxy, it works on the respiratory system as opposed to the liver. If you accidently take more than your body can process and go to sleep...your chances of not waking up go way up. It then becomes an accidental overdose. Alchohol will get you in the long run but you don't find too many wine-oh's robbing liquor stores to get a fix (although I'm sure it does happen).

You body also has natural defenses when it comes to drug overdoses. 9 times out of 10 the user has a tendency to vomit any harmful contents. Chances of dying from any overdose are slim, possible, but slim.

I agree with my best friend OhMy. NEVER ASK THE FREAKIN' DA FOR ADVICE!!! THEIR JOB IS TO PUT YOU IN JAIL!! OF COURSE THEY"LL TELL YOU ANYTHING!
