Florida Name Change
My question involves name change laws in the State of: FL.
My x and I were not married or even a couple when my son was born, in fact I didnt even really know about him till I got a DNA summons.When he was born she gave him her last name. I have been proven to be the father and i have visitation and pay child support and provide extra things for my son but my question is can I have his last name changed to mine even if she doesnt agree with it?

You can certainly request it without her consent. It will be up to a judge whether or not the name will be changed. You can get started here:

The name change forms are at the bottom of the page. On the left side, at the top, is a link to self-help centers in Florida. Make sure you follow the directions if you plan to do this on your own.

This type of issue is usually addressed when paternity is established. Florida Statutes Sec. 382.013 describes how the surname is normally set at that time. If you did not request that the child's surname be changed at that time, it becomes less likely that a judge is going to now order a name change against the wishes of the custodial parent.
