Headlight That Did Not Require Repair
My question involves vehicle maintenance laws for the State of:California. My daughter got a fix it ticket in March and the issuing officer never mentioned that she had to go to court. He just told her she needed to get a headlight fixed. After he left, her passenger lifted the hood and found out the plug to the headlight was out, so they plugged it in and went on. There was no repair shop or part involved. She did not read the ticket and thought she had resolved the situation. She just received a notice from a collection agency that her license is on hold and she owes $700 dollars. Does she have any recourse?

    She can pay the fine.

It is generally expected that when one is handed a ticket by law enforcement, one reads it to determine what sort of trouble one is in, and what one must do to correct it.

"I didn't read the ticket" is not a defense.

I would write a letter to the court explaining the situation in detail. She has nothing to lose by doing so and just might get lucky.

Fix it tickets are usually written like a regular ticket. With the exception that any fines would be dismissed if you show up with in the specified amount of time written on the ticket. Showing you took the course of action to correct the mechanical problem.

It is not the courts fault that your daughter did not read the ticket carefully enough to understand this. Or that she did not contact the court to find out what needs to be done to resolve the ticket. Ignorance is not an excuse for the court.
