Caught Shoplifting in Mervyn's
My question involves criminal law for the state of: California
I was caught shoplifting in Irvine, CA. No police came, I was just fined and sent a civil demand, which I paid off right away. I was told not to trespass the store as well. However, I just recently tried to apply for a job whose company uses the same application process and hiring system as Mervyn's. That's not the thing though. I am a undergraduate student who is interested in going into pharmacy. I applied for a job online and got a letter saying that a consumer report obtained by a company may adversely affect my employment. Is there any way to clear this? I would love to go to pharmacy school. I am scared it will affect whether I get an internship or job upon graduation. I am a very serious student.
So in conclusion, I was wondering if I can clear this incident off the company's records. Thank you.

Since there was no Police involvment there is no criminal record to remove. It appears as though you were placed in a database shared by many retailers. there is no way to remove it

Do you know how long I will be in this database for?
Is there any way I can remove it by hiring an attorney to go to court?
The thing is, I think it will affect my chance of getting an internship while I am in a profesisonal graduate school.

They do clean out the database. I wish all people would answer with correct information. These databases are routinely cleared up. Call mervyns and ask the name and contact information for the database. Then post and I will tell you what to do and who to contact based on where the info got submitted.

I assumed that correct as I was told (on this very site) that said info was not cleaned out.

I am telling you that depending on the database it can be. Plus the law requires certain databases to be cleared out after a set period of time. Trust me I am more knowledgable about these things than most of you on the site as it is my job. I helped design and maintain a database for a national retailer.

Choicepoint is the company that does these consumer reports. Esteem is the database many retail employers do background checks on. I have called today and tried to put in a dispute. There was actually a discrepency when I signed papers. I didn't intend to sign away, agreeing that I would be put in a database by many retailers besides from Mervyn's, but I thought I was told to sign the papers to never come back into the store and to prevent the police from being called. I didn't know I would be put into a database, that will affect my future from getting a job that uses these databases. Can you please help me? Choicepoint filed this dispute I told them to Mervyn's and I will see what happens next. But so far, a retail place I applied to recently has this info about the theft incident, which is affecting me. Thanks.

Mervyns does not need your permission to put you in database. Fact you stole was enough
