Got RFE and Want to File New H1b from Different Company
I had file h1b from company A. I got selected in Lottery. My present case status is : Request for additional document sent. Now i got another offer from company B.
1. Can company B file file a new h1b petition for me ??
2. Will i be eligible for cap-exempt ??
3. What will be the best thing to do at this situation ??

I am in the same situation and looking forward to see immigration attorney. Someone told me (I am not sure how far it is true , I have to confirm from lawyer), rather than solving RFE , new employer can file new H1B application against the receipt number you have.
It is well known that you can not "transfer" H1B visa unless it is approved. In your and my case it may come under "transition" case, assuing you are on OPT, still I am looking for more clearification from attorney.

I need help on few questions , will really appreciate if you can guide based on your experience dealing with immigration cases.
The background is:
My H1 B petition was filed by an employer, the application was selected in the lottery in April 2008.
The Immigration firm handling my case was sent an RFE by USCIS with a reply back by date of Aug 4, 2008.
The current petitioner is procrastinating providing the paper work required as per the RFE - suggesting they are in the process of compiling the same.
I fear that the employer may not be in a position to get the paper work in time,which may result in denial to my H1B application. Do you think there is a way to handle this situation?
Additionally I was thinking
1) Is it possible my friend can get an extension on the RFE?
2) Is it possible to transfer the existing H1B application to another petitioner/ employer and by some time to get the paper work in place?
Really appreciate if you can answer this or advise or suggest.

I'm in the same situation. I want to company B file new h1b petition for me. Company A has problems with RFE from USCIS.
Can anybody comment this situation? Is it possble? What did immigration attorney say?
