    Credit Card Fraud from 2001
My question involves criminal law for the state of: Indiana

In 2001 when I was in college, a friend and I used my roomates credit card without her knowledge. I left college and moved back home. I was sent a letter from the police to come back down to that county and fill out a statement. I did that. They told me if any charges were going to be filed, they would contact me. I have not heard anything and it is now 2008.

I recently applied for a job and received a copy of my background check back. I have charges for forgery and an active warrant on my background check. I have had 5 jobs since 2001 and not once did I receive anything about this background check.

I contacted the police department and spoke with a detective. He said there was an active warrant for my arrest for fraud. I have not been "hiding" or anything from this. They have not contacted me at all regarding any type of warrant or charges, the only time they contacted me was when I filled out a statement and was not read my rights and I did not plea to anything.

I was pulled over and given a ticket a few months ago and was not told there was a warrant for my arrest.

My husband is a US Marine and his Master Sergeant is going to call the Prosecutors Office for me. What can I expect to happen next? They never told me they were pressing charges nor did anyone inform me I had a warrant for my arrest.

If I were to go before a judge, which will be hard to do because I live in North Carolina on a Marine Base now and this happened in Indiana, I wouldn't even know what to tell her it was so long ago. I don't even remember what all happened? What kind of charges would I be looking at? Is there a statute of limitations? I was not even contacted that I had a warrant for me.

    Please help!!

Edit: I wanted to add that I was only 18 at the time. I have not committed any other crimes.

You need to hire a lawyer NOW.

If the police contact you do NOT give them any statement. Only your name, address, social security number and DOB if they request it.

You need to NOT talk to them, and NOT sign anything for them.

Just because you have had several jobs, that does not mean that they ran background checks on you.

Either way at this point you need to hire a lawyer NOW to handle this. DO NOT put this off and do not try to handle this on your own.

I hope this all works out for you, keep us advised;)

I gave a statement in 2001 and they said that if they were going to press charges they would contact me and they never did. I called the detective today thinking it was just a warrant for me to fill out the statement that I did back in 2001. He said it was a warrant for me in the state of Indiana for fraud, and to contact the prosecutors office. I live in North Carolina now because my husband is a Marine and this happened in Indiana.

DO NOT CONTACT the prosecutors office. You need to hire an Indiana lawyer to handle this for you. Was it Marion county? Johnson county? I know those people up there and do not think for a minute that this is something you can handle by yourself.

I am very concerned about what was in your statement back in 2001. I just hope you did not admit to any wrong doing.

This site can find you a lawyer in Indiana. You need one NOW and ASAP

How can I hire a lawyer to talk to while I am in North Carolina.... I can't travel home right now. Can't I hire a lawyer in North Carolina? Why shouldn't I contact the prosecutors office?

    It was in Delaware County.

I don't even remember what I wrote in my statement. I put it all past me and forgot about it because they never said they were pressing charges.

Oh ok, that would be Muncie Indiana??

I do not know the the people who work in that county. You need an Indiana attorney, NOT a NC one. I am not saying that you have to run back to Indiana today, however, you need a lawyer in Indiana NOW to represent you and hanlde this.

YOU NEVER SPEAK to a prosecutors office NEVER. I am a criminal investigator and I will tell you now, NEVER speak to law enforcement that is investigating you. You may say something that they can use against you without you even realizing what you said.

And if your lawyer says you need to go back to Indiana, then you have to go. You do whatever your lawyer tells you to do.

See, my point exactly. In your prior statement you may have said somthing that caused this to turn into a charge. Again, say nothing to anyone but your own lawyer in Indiana which you will hire no later then tomorrow.

Yes, Muncie. I looked up lawyers there and will contact tomorrow.

I don't understand how I haven't been told about this warrant, I was even pulled over.... I don't get it.

What kind of charges would I be facing? I was 18 and it was my first offense. It's been 7 years and they still haven't tried contacting me and I haven't been hiding.

Will I be able to read what I wrote in my statement again?
