Name Change While Adoption Is Pending
O.k. Wow! I am in the SAME position as this post!! But i am the stepfather in this case.... We have file for the legal step parent adoption... cost under $300 and the sperm donor has given consent to adoption. :D Here is were it gets sticky for me... I have some legal issues that the judge not the social worker had issues with! He wanted me to wait until my probation finished before he finalized adoptions. this two years away and our little one (4) has gotten used to say my last name. she is now headed for kindergarden and school is going to treat her the donors name... so we are going to attempt to change her last name so that at least she can continue that until the adoption is complete. is that possible or not? he has signed the paper to terminate his rights?

Just be advised that all a name change does it just that...changes the name. If something were to happen to you, the "sperm donor" will be able to get her. Adoption will terminate his rights and that way if something happens to you, your daughter would be go to your current husband. My son's "sperm donor" passed away three years ago and I was just going to change his name, but learned that my family and the "sperm donor's" family would be able to take my son away from my husband if he didn't adopt him. I purchased a packet for adoption from a legal supply store here in Las Vegas for $75 and have filed the adoption paperwork for $116. It is alot cheaper than going to an attorney and really hasn't been very hard to do. As long as you have a computer and can type and follow instructions, it is pretty easy. Don't know how easy it is for California though. Good luck!

I understand what you are saying in regards to the donor, and we are dealing with that also, but my concern is the immediate results of her (little one) having the be taught different last name. i will confuse her to know end, she knows nothing about the donor!! So was wondering if anyone knew if we could indeed change her last name, since the donor signed away his rights? that this point i guess i am even willing to pay attorney (if someone could recommend one) for adoption legal issues and/or name change
