    My question involves criminal law for the state of: Florida

    My daughter is 15, a friend of my son is 21, this man is in love with my daughter and hangs around a lot, this young man posted something on his myspace about the florida satutes, in essence, he is of the opinion that he is allowed in this state to have sex with my daughter at age 15, since he is under 24.

    before I have one of those father to wannabe boyfriend talks about sex with my minor daughter and the ramifications, I thought I might solicit some info here. What are my rights as a parent, if any, and are there cases where a young man has been arrested or convicted in florida for having sex with a minor. As a parent, I am inclined to make threats, etc... but i want to know where i stand, before doing anything.

    Don't make threats of violence - though I certainly understand the inclination to do so!

    You can, however, make threats of legal action. She is your MINOR child, and as such, you can forbid her from seeing him entirely and file for a restraining order.

    The age of consent in Florida is 16. If he lays a hand on her, have him charged with sexual battery.

    Also, Lewd and Lascivious offense could be an issue.

    Depending on the law in FL, criminal threats might have to be immediate ... a conditional threat, such as, "Touch my daughter and I'll break your arm!" might not be criminal.

    I am not recommending such an action, but I can say from experience that the odds of the police pursuing it in this case is slim, and the chances of the DA taking something like that to trial even less. All the defendant would need on the jury is one parent - particularly a father - and he's probably get off. So, the chances of charges here would be slim ... provided dad doesn't actually carry it out.

    Of course ... even carrying it out might not result in a conviction for similar reasons ... :D

    Her son has been in a Florida prison for 12 years for having consensual sex with his minor girlfriend.

    Florida's "Romeo exception" doesn't start until the minor in question reaches age 16, NOT 15. There's no loophole that allows sexual activity prior to 16. Period. Zero. Zip. None.

    Even once she reaches 16, the adult party must UNDER 24 years of age. Once he enjoys his 24th birthday party, anyone under age 18 is OFF LIMITS.

    If you plan to report a sex crime against your daughter, do it soon.....do it NOW.

    Also, as her legal guardian, you can obtain a restraining order against Mr. Wonderful - ordering no contact - EVEN IF your daughter objects.

    As a parent you have the legal right to deny your minor child see this person even if they intend to do nothing more than gaze into each others eyes! If you wish to further protect the minor the parent can seek a protective order. This mean sif the adult tries to contact the minor in any way the adult can go to jail!
