J1 to Green Card, Once Spouse Gains Permanent Residency
I am a medical graduate from india currently on a B1 till jan 2006. I am applying for residency positions and am likely to be sponsored for J1 visa. I am also engaged to an H1 holder in the US who has applied for his green card this year. we are getting married in january 2006 and my J1 will come through in may 2006. once married, can i change my status once his green card comes through, or will i have to fulfill the requirements of the J1 including the waiver? thanks.

    Mr. Knowitall
    Marriage & Status
(I hope one of the immigration experts who float through here periodically will give you a definitive answer; but it would probably be wise to discuss your situation with an immigration lawyer.)

I think he has to be a citizen before you and he can petition to adjust your status on the basis of marriage.
