Judges don't talk to people privately about cases - ANY type of case - EVER. Whatever is relevent to a case needs to be addressed in court (or in chambers with attorneys for both sides present), be on the record, and be disclosed to the other party. Doing so would totally destroy the whole concept of a judge being impartial and unbiased (not to mention that it could get them disbarred).
What you are describing is illegal. However, I have seen 3 different, very biased Judges who actually did allow it, although it is illegal. (most Judges are fair and law abiding, but as in every profession, there are some who don't care about the laws).
If you believe that a Judge in your case has improperly allowed ex-parte communication, and you have some kind of proof, you can file a complaint with your state's Judicial Qualifications Committee. If you have definate proof and your case is still pending, you can use that proof to formally request a different Judge.
