OTR Truck Driver With A Misdemeanor Record
My question involves a background check in the State of: TN
My husband has been terminated from 5 positions in the past 1 1/2 yr after background checks have been completed. In all cases, he has informed his employer of what he believes is on the background check and they have hired him anyway with the response of "we'll see if it shows up." However, the last employer fired because of "lying on application," however, from our records he didn't lie on application. He has not had a problem finding a job or being hired - he has a lot of experience, has HAZMATs (for which he had to petition w/Dept of Homeland Security and pass interview and background investigation) and tankers.
This only started about 1 1/2 yrs ago. His last misdemeanor was over 5 yrs ago and a very minor infraction. Prior to that time he did have a lot of misdemeanors -- majority of which were 20-12 yrs ago. No felonies. We are contesting several backgrounds investigations that have been completed, but have not gotten any finalized. We have printout from local court and all misdemeanors occurred here. We have TBI investigation. There are many inaccuracies, but now we are in bankruptcy and he will probably face jail time for being behind in child support and only paying portion.
Is anyone aware of any issues that may have started in the past 2 yrs in TN w/regard to background checks or is this because so many employers are using online providers. Our ADA has even checked into record and does not understand why he is being terminated and/or not hired -- at this time due to local laws governing expungement he is not eligible as he did not req diversion on any of the charges.

When he completes an application for employment, he needs to read how the questions are worded & answer truthfully. All background checks are not the same - some are more thorough than others so it is hard to say what will be picked up on any individual one. His being terminated from jobs could have something to do with his "criminal" hx & also his current credit hx (ie current bankruptcy). There's a possibility they could even pick up that he is behind in child support. If they believe there is a possibility of jail time for being behind in child support, I could where they would not want to hire him.

would the types of crimes matter? all we know is that its not felony.

Whether he gets hired after a background check would be up to each individual employer - some may, some may not hire him. I would think most employers would consider the crimes, the # of crimes, & the length of time elapsed since they were committed. There may be other information on the background check besides the crimes which could keep him for being hired by some employers such as an adverse credit check. No one can say what any individual employer might do - they take the job being applied for into consideration also.
