    Retail Fraud Charges For Minors In Michigan
    My question involves criminal law for the state of: Michigan

    My girlfriend and one of her friends were caught shoplifting today at a Wal Mart. She had items totaling $23 and her friend had $37 worth. Her friend is 17, and she was placed under arrest and given a court date. My girlfriend will be 17 in a few days, and she's worried about being charged as an adult for this, rather than as a minor. She was given a court date as well, but not placed under arrest. What will the charges be for her? I've read about cases where it was just the Civil Demand fine and probation, or possible a diversion program.

    Also, how will the charges affect her record? She'll be applying to colleges in the fall, and I'd like to know how the outcome of this may affect her chances of getting in. She's a first time offender, not even a speeding ticket on her record. She's got good grades and is involved at school and in the community. It was a big lapse of judgement, but will the DA and judge take that into account?

    Since we dont know the charges we cant say. If convicted she will have a criminal record. How that impacts College and job searches is up to the schools and employers

    She said that she was being charged with Retail Fraud.

    What I'd really like to know is whether they'll charge her as an adult, as she'll be 17 on Sunday, or whether they'll treat her as a minor, since she was 16 when the crime was committed.

    Also, she wasn't placed under arrest or anything. She signed the ban from the store and gave her info, but the police arrested her friend, who is 17.

    We cant say how she will be charged thats up to DA and local laws. She was arrested though. Her arrest was from store security it was a citizens arrest

    The police didn't come and arrest her, though. Her friend was actually handcuffed and put in the squad car. They just had her sit in the LP office and wait for her parents to show.

    If she was sixteen when she committed her crime, there's no reason to expect that it won't be handled as a juvenile court matter. As you say she committed retail fraud, it stands to reason that she will be charged with retail fraud.
